Welcome to Beni Destiné. These Terms of Service (“Terms”) govern your access to and use of Beni Destiné’s website, products, services, and purchases made through our website, social media, custom-order arrangements, and other authorized Beni Destiné sales channels.

By accessing our website, placing an order, requesting custom work, or purchasing from Beni Destiné, you agree to these Terms.

1. ABOUT BENI DESTINÉ

Beni Destiné is an independent jewelry brand specializing in handcrafted jewelry, including one-of-a-kind and limited-availability pieces.

Our designs may incorporate natural gemstones, pearls, glass, metals, handmade beads, artisan components, vintage components, and other natural or manufactured materials.

Because our jewelry is handcrafted and many of our materials have natural characteristics, variations are expected and are part of the individuality of each piece.

2. HANDMADE & ONE-OF-A-KIND JEWELRY

Many Beni Destiné designs are handmade, one-of-a-kind, or produced in limited quantities.

Natural gemstones, pearls, shells, glass, handmade beads, vintage components, and similar materials may contain variations in color, size, shape, texture, pattern, markings, inclusions, or finish.

These characteristics are not considered defects.

We make reasonable efforts to accurately photograph and represent our products. However, product colors and details may appear differently depending on lighting, photography, screen settings, and the device used to view the product.

For one-of-a-kind pieces, the item shown may be the only piece available. Once purchased, an identical replacement may not be possible.

3. PRODUCT DESCRIPTIONS & MEASUREMENTS

We make reasonable efforts to ensure product descriptions, materials, measurements, photographs, prices, and other information are accurate.

Because pieces are handmade, minor variations in measurements, placement, construction, and appearance may occur.

Customers are responsible for reviewing product descriptions, measurements, sizing information, materials, and photographs before purchasing.

If you have questions about sizing, materials, or a particular design, please contact Beni Destiné before completing your purchase.

4. ORDERS & AVAILABILITY

Products are subject to availability.

Because Beni Destiné sells through multiple channels, including our website, social media, and in-person markets, it is possible for a one-of-a-kind or limited-quantity piece to sell through another channel before website inventory is updated.

If an unavailable item is purchased due to an inventory timing issue, Beni Destiné may cancel the affected order and issue a refund for the unavailable item.

Placing an order does not guarantee acceptance. Beni Destiné reserves the right to decline or cancel an order when reasonably necessary, including suspected fraud, payment issues, pricing errors, inventory errors, or other circumstances that prevent us from completing the transaction.

If Beni Destiné cancels a paid order, the applicable amount paid for the canceled item or order will be refunded.

5. PRICING & PAYMENT

All prices are listed in U.S. dollars unless otherwise stated.

Prices may be changed at any time without notice. Price changes do not apply retroactively to completed purchases, except where an obvious technical or pricing error occurred.

Applicable taxes, shipping charges, and other applicable fees will be shown when required.

Payment must be completed using an accepted payment method.

Beni Destiné reserves the right to correct pricing, typographical, inventory, or listing errors.

6. CUSTOM ORDERS

Custom and personalized orders require additional time, communication, materials, and design work.

Before beginning custom work, Beni Destiné may require approval of design details, measurements, materials, pricing, and other specifications.

Customers are responsible for providing accurate sizing, measurements, spelling, design requests, and other information necessary to complete the order.

Once materials have been purchased, production has begun, or customization has been performed, a custom order may not be canceled, changed, returned, or refunded except where required by law or where the finished item is defective or materially different from the agreed specifications.

Natural variations in gemstones, beads, and other materials do not constitute a failure to meet custom-order specifications when the materials otherwise reasonably match the agreed design.

Any custom-order deposit designated as non-refundable before payment will remain non-refundable to the extent permitted by law.

7. IN-PERSON & MARKET PURCHASES

Products purchased at vendor markets, pop-ups, festivals, exhibitions, or other in-person events may be subject to the return conditions communicated at the time of purchase.

Customers are encouraged to inspect jewelry, confirm sizing, and ask questions before completing an in-person purchase.

Proof of purchase may be required for returns, exchanges, repairs, or other requests.

8. SOCIAL MEDIA ORDERS

Orders arranged through social media or direct messaging are not considered confirmed until Beni Destiné has accepted the order and any required payment has been successfully completed.

Customers should only submit payments through payment methods or payment instructions directly authorized by Beni Destiné.

These Terms also apply to eligible purchases arranged through Beni Destiné's authorized social media accounts.

9. SHIPPING & DELIVERY

Customers are responsible for providing an accurate and complete shipping address.

Beni Destiné is not responsible for delays or delivery problems resulting from incorrect or incomplete information provided by the customer.

Processing and delivery dates are estimates unless expressly guaranteed.

After a package has been transferred to the shipping carrier, delivery may be affected by carrier operations, weather, holidays, transportation disruptions, or other circumstances outside Beni Destiné's reasonable control.

If a shipment is lost, damaged, significantly delayed, or marked delivered but cannot be located, please contact us so we can determine the appropriate next steps. Customers may also be required to cooperate with a carrier investigation or claim.

10. 14-DAY RETURN POLICY

We have a 14-day return policy. You have 14 days after receiving an eligible item to request a return.

To be eligible for a return, your item must be:

• In the same condition in which you received it;

• Unworn and unused;

• Accompanied by its original tags, if applicable;

• In its original packaging; and

• Accompanied by a receipt or other proof of purchase.

Returns must be requested and approved before merchandise is sent back.

If your return is accepted, we will provide a return shipping label and instructions regarding how and where to send your package.

Items returned without first requesting and receiving return authorization may not be accepted.

11. DAMAGES & ORDER ISSUES

Please inspect your order when you receive it.

If an item arrives defective or damaged, or you receive the wrong item, contact Beni Destiné immediately so we can evaluate the issue and determine an appropriate resolution.

Photographs or other reasonable documentation of the item, packaging, or shipping damage may be requested.

Damage resulting from wear, misuse, improper storage, exposure to chemicals or water, accidental damage, unauthorized modification, or failure to follow reasonable jewelry-care practices is not considered an item arriving defective.

12. NON-RETURNABLE ITEMS

Sale items and gift cards are final sale and cannot be returned.

Custom or personalized pieces may also be final sale once production or customization has begun, as described in the Custom Orders section of these Terms.

Please contact us before purchasing if you have questions about whether a particular item is eligible for return.

13. EXCHANGES

We do not process direct exchanges unless Beni Destiné expressly agrees otherwise.

The fastest way to obtain another item is to return your eligible item. Once the return has been accepted, you may make a separate purchase for the desired item.

Because many Beni Destiné designs are one-of-a-kind or limited in quantity, we cannot guarantee that another item will remain available while a return is being processed.

14. REFUNDS

We will notify you after we receive and inspect your return and advise you whether the refund has been approved.

If approved, the refund will be issued automatically to your original payment method within 10 business days.

Your bank, credit card company, or payment provider may require additional processing time before the refund appears in your account.

If more than 15 business days have passed since Beni Destiné approved your return and you have not received your refund, contact benidestineadornment@gmail.com.

15. ORDER CANCELLATIONS

If you need to cancel an order, contact Beni Destiné as soon as possible.

Cancellation requests are not guaranteed.

Once an order has entered processing, been packaged, shipped, or—in the case of custom work—entered production, cancellation may no longer be available.

If an order has already shipped, an eligible customer may request a return after receiving the order in accordance with our Return Policy.

16. JEWELRY CARE & NORMAL WEAR

Jewelry requires appropriate care.

Exposure to water, sweat, perfume, lotions, cosmetics, household cleaners, chemicals, humidity, or improper storage may affect metals, gemstones, finishes, wire, cord, beads, plating, and other components.

Depending on the material, natural tarnishing, patina, gradual finish changes, and ordinary wear may occur over time and are not necessarily defects.

Customers are responsible for following care instructions provided with their purchase or made available by Beni Destiné.

17. REPAIRS

Beni Destiné may offer repair services on certain pieces at our discretion.

Whether a piece can be repaired depends on its condition, construction, age, and the availability of original or comparable materials.

Repairs required because of customer damage, normal wear, improper care, or lost components may be subject to repair, material, and shipping charges.

Because many materials are unique, vintage, natural, handmade, or limited in availability, Beni Destiné cannot guarantee that replacement components will be identical to the originals.

18. SAFETY & MATERIAL SENSITIVITIES

Customers with known metal, gemstone, or material sensitivities are responsible for reviewing available product information before purchasing.

If you have a known sensitivity or allergy, contact Beni Destiné before purchasing if you need additional available information about a product's materials.

Jewelry containing small components should be kept away from young children and pets.

Discontinue use of jewelry that becomes damaged in a way that creates sharp edges, exposed wire, loose components, or another potential safety concern.

19. CHARGEBACKS & PAYMENT DISPUTES

If you believe there is a problem with an order, we encourage you to contact Beni Destiné at benidestineadornment@gmail.com so we have an opportunity to investigate and resolve the issue.

Beni Destiné reserves the right to provide order confirmations, shipping records, tracking information, delivery confirmation, customer communications, return-policy information, photographs, custom-order approvals, and other relevant transaction documentation to banks, card issuers, payment processors, or other parties involved in investigating a payment dispute or chargeback.

Nothing in this section limits a customer's lawful right to dispute an unauthorized or otherwise legitimately disputed transaction.

20. PROMOTIONS & DISCOUNT CODES

Promotions, sales, giveaways, and discount codes may have additional terms or eligibility requirements.

Unless otherwise stated, discounts cannot be combined, redeemed for cash, or applied retroactively to previously completed purchases.

Beni Destiné reserves the right to correct or cancel promotions affected by obvious errors, misuse, fraud, or technical problems.

21. INTELLECTUAL PROPERTY

The Beni Destiné name, branding, logos, original jewelry designs, product photography, graphics, written descriptions, website content, and other original creative materials are owned by or licensed to Beni Destiné and are protected by applicable intellectual property laws.

You may not reproduce, copy, distribute, commercially exploit, republish, or represent Beni Destiné's protected materials as your own without authorization, except where permitted by law.

Purchase of a Beni Destiné product does not transfer intellectual property rights in the design, branding, photography, or other protected creative material associated with that product.

22. WEBSITE USE

You agree not to misuse our website or interfere with its normal operation.

You may not knowingly use the website to engage in unlawful activity, fraud, unauthorized access, malicious activity, or other conduct that could damage Beni Destiné, its customers, or its service providers.

We reserve the right to restrict access or cancel transactions when reasonably necessary to protect the security or integrity of our business and customers.

23. THIRD-PARTY SERVICES

Beni Destiné may use third-party providers for website hosting, payments, shipping, analytics, communications, and other services.

Those services may be governed by their own terms and privacy practices.

To the extent permitted by law, Beni Destiné is not responsible for failures or interruptions caused solely by independent third-party services outside our reasonable control.

24. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Beni Destiné will not be liable for indirect, incidental, special, or consequential damages resulting from use of our website, services, or products.

Beni Destiné is not responsible for damage resulting from misuse, improper jewelry care, unauthorized alterations, normal wear, or use inconsistent with provided care or safety instructions.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits any non-waivable consumer rights.

25. PRIVACY

Personal information collected through our website or transactions is handled in accordance with the Beni Destiné Privacy Policy and applicable law.

Please review our Privacy Policy for information about how personal information is collected, used, and protected.

26. CHANGES TO THESE TERMS

Beni Destiné may update these Terms periodically to reflect changes in our business, policies, services, website, or applicable requirements.

The current version will be posted with its effective or “Last Updated” date.

Changes apply prospectively unless otherwise required by applicable law.

27. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

28. GOVERNING LAW

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable federal law or mandatory consumer protection law provides otherwise.
